Purpose and scope

These terms and conditions govern the contractual relationship between 404 AFK, SAS, and any business client wishing to use its web development, business application, AI tool or third-party application maintenance (TMA) services.

Any order for services implies unreserved acceptance of these terms and conditions.

Services offered

404 AFK offers website development, business application, AI and automation tool services, as well as third-party application maintenance (TMA), debugging and code audit services.

These services are provided based on a prior quote, according to a need expressed by the client. The site does not offer any online sale or payment.

Quotes, orders and pricing

Each service is the subject of a written quote detailing the scope, indicative timelines and price, established after a prior discussion with the client.

The order is deemed final upon receipt of the client's acceptance of the quote (signature, email or any other written means).

Payment terms and timelines

Payment terms (deposit, installments, balance) are specified in each quote. The stated timelines are indicative and may change depending on the actual scope of the project and client feedback.

Obligations of the parties

404 AFK undertakes to carry out the services diligently and according to best practices. The client undertakes to provide, within reasonable timeframes, the information, access and approvals necessary for the proper performance of the service.

Intellectual property of deliverables

Unless otherwise stated in the quote, intellectual property rights over deliverables developed specifically for the client are transferred upon full payment of the service. 404 AFK retains the right to reuse generic technical building blocks not specific to the client.

Liability and warranties

404 AFK undertakes to correct, within a reasonable timeframe, any malfunction resulting from a defect in the delivered service, as reported by the client. 404 AFK's liability cannot be engaged in the event of misuse of the deliverable, modification by an unauthorized third party, or failure related to infrastructure outside its control (host, network, third-party service).

Confidentiality

404 AFK undertakes to keep confidential all information communicated by the client in connection with the service, unless otherwise agreed by the client or required by law.

Right of withdrawal

As the services are intended exclusively for business clients, the right of withdrawal provided for by the French Consumer Code does not apply.

Applicable law and disputes

These terms and conditions are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution before any legal action. Failing that, French courts shall have sole jurisdiction.
